Why Your Conveyancer Is Asking More Questions Than Ever

Purchasing or selling property in Australia has always involved paperwork, identity checks and legal requirements. However, from 1 July 2026, a significant change will affect property transactions across New South Wales and the rest of Australia. New Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) laws will apply not only to banks but also to industries involved in property transactions, including conveyancers, lawyers, accountants and real estate professionals.

At first, some clients may be surprised when their conveyancer requests additional identification documents, information about the source of funds, or details about how a purchase is being financed. These questions are not designed to make the process more difficult. They are now part of a national effort to prevent criminals from using the property market to conceal proceeds of crime or facilitate serious financial offences.

Financial crime is estimated to cost Australia up to $82 billion each year. According to AUSTRAC, these reforms are designed to close loopholes exploited by criminals involved in corruption, organised crime, illicit tobacco operations, environmental offences, child exploitation and human trafficking. Because property transactions are considered a high-value target, stronger verification requirements are being introduced across the industry.

What Information May Be Required?

Compliance RequirementWhy It Matters
Verification of IdentityConfirms that you are authorised to complete the transaction
Source of FundsDemonstrates where the money used for the purchase originated
Source of WealthHelps explain how assets were accumulated over time
Ownership StructuresIdentifies individuals who control companies or trusts
Occupation and Business ActivitiesAssists in understanding the client’s financial profile
PEP ChecksAdditional screening for certain public officials and their associates
Ongoing Risk AssessmentHelps identify unusual or suspicious activity during the transaction

For buyers and sellers, these changes may mean providing information earlier in the conveyancing process than ever before. Depending on the nature of the transaction, documents such as passports, driver’s licences, bank statements and loan approval documents may be required. While this may feel unfamiliar, providing the information promptly can help avoid delays and keep settlement on track.

Preparation is becoming increasingly important in property transactions. Buyers who have their identification and financial documents ready are likely to experience fewer interruptions throughout the process. Similarly, sellers who respond promptly to verification requests can help keep contracts progressing smoothly towards settlement. In many cases, the fastest and most efficient transactions are achieved by the clients who are the most organised.

The good news is that the industry has been preparing for these reforms well in advance. Conveyancers, lawyers and real estate professionals are implementing new systems, training programs and compliance procedures to meet the requirements of the legislation. The objective is not only compliance but also protecting clients, property ownership and the integrity of Australia’s property market.
