What Happens When a Property Owner Passes Away?
- The legal steps depend on how the property was registered on title:
- Joint Tenants (Survivorship Application): If you owned the home as joint tenants, the property automatically transfers to the surviving owner. We lodge a notice of death along with the official death certificate to remove the deceased person's name and record the survivor as sole owner.
- Solo Owner or Tenants in Common: If the deceased was a solo owner or only owner, the title must be transferred to the correct beneficiary or executor via a transmission application before ownership can change.
