What is PEXA?

PEXA is essentially online conveyancing. It’s faster, safer, and, as a vendor, has your surplus funds in your bank account, as cleared funds, within 20 minutes to an hour of settlement. As a buyer, you’ll avoid unnecessary fees for bank cheques, and you’ll be registered as the new owner within 20 minutes to an hour of settlement. As a Certified PEXA office, we can make sure you get all the benefits of this leading technology, making the process even faster, smoother and safer for you.

How Can I Obtain a Certificate of Compliance?

Local councils and registered swimming pool inspectors (certifiers) can inspect swimming pool and spa pool barriers and issue a certificate of compliance if the barrier meets requirements.

Pool owners should contact their local council or a private certifier early, to allow time to organise an inspection before renting or selling a property. A certificate of compliance is valid for three years.

Do you have a Swimming Pool or Spa?

With over 300,000 backyard swimming pools in NSW, swimming pool safety is a vital issue that affects the whole community.

If you’re selling a property with either a swimming pool or spa you must have:
⦁ A valid swimming pool certificate of compliance, or
⦁ A relevant occupation certificate issued within the last 3 years, or
⦁ A valid certificate of non-compliance.

If these certificates are not attached to the Contract of Sale as required, the purchaser may be allowed to rescind the contract within 14 days of exchange, unless settlement has already occurred.

If a certificate of non-compliance is attached to the contract for sale, the vendor is transferring the obligation to obtain a certificate of compliance to the purchaser.
The purchaser will have 90 days from the date of settlement to rectify defects listed in the certificate of non-compliance and obtain a certificate of compliance.
This requirement does not apply to a lot in a strata scheme or in a community scheme if that strata or community scheme has more than two lots, or if the sales contract is for an off-the-plan property.

A swimming pool certificate of compliance is valid for 3 years from its date of issue. To check if a certificate of compliance has been issued, go to the NSW Government’s Swimming Pool Register.
