Balout v Dobro Dosle Pty Ltd [2025] NSWCA 275: What This Case Means for Property Agreements and Conveyancing

The recent case of Balout v Dobro Dosle Pty Ltd shows us a great deal about property transactions. More specifically, this amount was $22 million, depending on which version of the agreement applied. In this instance, the consequences were considerable when it was established by the Court of Appeal that Touma lost his entitlement to payment under the agreement as a result of his failure to make the required payments. To avoid a legal dispute and the loss of entitlements (for example, a deposit), the buyer, seller, and their respective solicitors must ensure that all relevant terms are complied with, such as the agreed payment schedule.
