How the NSW Stamp Duty Exemption Works
- Under Section 104B of the NSW Duties Act 1997, transferring a share of your home to your spouse or partner is completely exempt from transfer duty ($0 stamp duty) if you meet a few basic conditions:
- Principal Place of Residence: The property must be your main home, where you both actually live.
- Relationship Status: You are legally married, or have been living together in a de facto relationship for at least two continuous years.
- Equal Ownership: The home must be held in equal shares (50/50 joint tenants or tenants in common) after the transfer.
