New Rules for Swimming Pool Registers in NSW – Important for Property Owners and Buyers

Having a swimming pool is a great addition to many homes across areas such as Blacktown, Kellyville, Rouse Hill, Schofields, Marsden Park, Castle Hill, and more in NSW. On the other hand, owning a pool also creates legal responsibilities that are relevant to the conveyancing process, property sales, and compliance checks. Both the vendor and purchaser should ensure that a property with a pool being sold has been properly registered and complies with NSW safety laws under the Swimming Pools Act 1992.

Real estate agents often promote pools as a lifestyle benefit during the sales process. However, behind the scenes, conveyancers must check registration and compliance before settlement. The NSW Government will launch an improved Swimming Pool Register in March 2026, which will provide clearer and more reliable information about pool registration and compliance.

The revised register includes several enhancements that will benefit property owners, councils, and certifiers. Importantly, the system will now link pools to the property address rather than the owner, making it easier to track compliance when the property is sold. Owners and buyers should understand key points including:

  • The Swimming Pool Register in New South Wales will become the single source of truth for pool registration and compliance.
  • Pools and spas will be registered using the property address, not the owner’s name.
  • The upgrade will enable clearer communication and information sharing between councils, certifiers, and applicants.
  • Pool owners must ensure that their pool is registered and complies with fencing and safety regulations.

Any pool or spa that can hold more than 30 cm of water is regulated by NSW law. This includes portable or inflatable pools. Owners must ensure that safety features such as the following are in place:

  • A safety barrier that prevents harm to children and complies with Australian Standard AS1926.
  • Pool fencing that is at least 1.2 metres high, with gaps no larger than 10 cm.
  • A non-climbable zone of 90 cm around the fence so children cannot climb over it.
  • Gates that self-close and self-latch, opening away from the pool area.
  • A CPR sign clearly visible from three metres away.

Serious consequences can result from non-compliance with these rules. Under swimming pool safety laws, drowning in backyard pools remains one of the leading preventable causes of death for children under five. If pool barriers do not meet Australian standards, councils can impose fines, compliance orders, or require costly repairs.

If property sellers have a pool that is not compliant, settlement may be delayed or the sale may become more complicated. Buyers may also need to pay for repairs identified during the conveyancing process. Areas such as The Ponds, Box Hill, Norwest, Glenwood, Baulkham Hills, and Winston Hills have experienced strong property growth. Before placing a property on the market, owners should ensure the pool is properly registered and compliant to avoid stressful last-minute issues and help keep the sale process moving smoothly.
